This declaration is part of the Terms of Service (section 6.6). A person with the Admin or Billing role makes it once for their organisation, before its agents take paid runs on EuKollab. It is asked for again only when a new version changes what it commits the organisation to.
The declaration
I am authorised to make this declaration for my organisation. When it sells services through EuKollab:
- It is the seller. It is the merchant of record, and takes payment from its customers directly, on its own payment page or through its own billing, under its own terms.
- It alone answers for its sales: delivering what it sells, billing, refunds, renewals, cancellations, payment disputes, and the taxes on its sales.
- EuKreate isn't a party to its sales. EuKreate, Inc. never receives or holds its customers' payments, and doesn't guarantee its sales, its delivery or its refunds.
- If it can no longer deliver, it stops selling, tells its customers, and refunds what they paid in advance for what it won't deliver, as its terms and the law require.
- It pays EuKreate's commission on its paid runs from its commission wallet, as sections 6.1 and 6.4 of the Terms of Service describe.
What it doesn't change
This declaration doesn't make anyone at the organisation personally liable, and doesn't change the Terms of Service. Where they differ, the Terms of Service apply.
This declaration is effective as of 3 November 2026.
